Fair Use Policy
1. Introduction
This Fair Use Policy ("Policy") outlines the terms and conditions governing the fair usage of the subscription-based barber services provided by Nathans Barber Group Limited ("the Company"). The aim of this Policy is to ensure that all members have equitable access to haircuts and related services without abuse or overuse that might compromise the availability for others. By becoming a member of Nathan’s Club operated by Nathans Barber Group Limited, you acknowledge and agree to adhere to this Fair Use Policy.
2. Subscription Types and Fair Use Threshold
The Company offers a variety of subscription types as part of its Club Member programme. Club Membership covers all haircuts and beard trims in a variety of combinations and types that are priced differently and last different lengths of time depending on the package type. To maintain fairness in service access, the concept of "fair use" is defined as the average number of cuts per month per member for the membership type. For clarity an appointment for a haircut is 20minutes only for a classic cut, 30minutes only for a skin fade and an additional 10minutes only for all beard works (trims, shape-ups or line-ups). If a member requires a cut type that falls outside of these appointment lengths then we reserve the right to charge (at our sole discretion) a fair top up amount which will be charged in blocks of 10 minutes typically from £12.00 per 10 minutes block. In order to ensure appointment supply to all members is fair you cannot book sequential appointments at any time this would be an attempt to extend the appointment length rather than have another appointment and is not permitted. For further clarity we define a haircut as “requiring a growth of at least 6mm of hair between haircuts with the average male’s hair growing at a rate of 0.35mm per day. A trim is a haircut.”
3. Monitoring and Discretion of the Company
The Company will monitor the usage patterns of members to ensure that appointments are not unfairly monopolised by certain members. The Company retains the sole discretion to limit, amend, reduce, withdraw, or change fair usage thresholds based on usage data and operational considerations.
4. ELITE Membership
The Company reserves the right to extend an invitation-only ELITE membership to individuals who have been deemed to be unfairly using the service. ELITE membership allows continued access to services beyond the fair use threshold. Acceptance into the ELITE membership programme is solely at the discretion of the Company.
5. Commercial Viability
If the Company determines, at its sole discretion, that instances of over or unfair use are commercially unviable and chooses not to extend ELITE membership to the member, the Company may charge the member in full for all appointments exceeding the current monthly fair usage threshold. These charges are to be paid by the member promptly.
6. Commitment to Fair Use
By agreeing to this Fair Use Policy, members acknowledge and agree to use the Company's services fairly and equitably. Members understand that while usage needs may vary, the fair use approach ensures a balanced availability of appointments for all members.
8. Policy Updates
The Company reserves the right to modify or update this Fair Use Policy as necessary. Any changes to the policy will be published on the Company’s website.
9. Governing Law
This Fair Use Policy shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising out of or in connection with this Fair Use Policy shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
